1. Acceptance and Scope
These Terms of Use govern your access to the LandSentry website, your use of our forms, and any inquiry, quote request, order, purchase, upload, or communication submitted through the site. By visiting the site, sending us information, requesting a service, or purchasing work from us, you agree to these Terms of Use together with our Privacy Policy, Cookie Policy, and Disclaimer.
If you do not agree with these terms, please do not use the website, submit forms, or purchase services through the site.
2. What LandSentry Does
LandSentry provides independent land intelligence, parcel research, practical property context, mapping support, aerial and site-observation coordination, report preparation, and decision-support services for buyers, investors, families, and remote clients who need clearer information before committing to land-related decisions.
Our work is designed to help clients gather facts, organize parcel information, surface visible risks, understand unknowns, and identify sensible next steps. We do not sell land, represent sellers, earn brokerage commissions from your transaction, or promise a particular transaction outcome.
3. What LandSentry Does Not Provide
LandSentry is not a law firm, title company, bank, brokerage, surveying authority, valuation office, planning agency, engineering firm, or licensed financial advisory business. Unless we expressly state otherwise in a separate written agreement, LandSentry does not provide legal advice, financial advice, tax advice, investment advice, title certification, boundary certification, valuation guarantees, lending advice, permitting approval, or regulatory clearance.
Any report, message, recommendation, research summary, or map we provide is informational and decision-support in nature. Final decisions about buying, selling, financing, transferring, surveying, building, registering, subdividing, or developing land remain your responsibility.
4. Eligibility and Authority to Act
You may use this site only if you are legally able to enter into a binding arrangement with us. If you submit information on behalf of a family member, company, trust, principal, or client, you represent that you have authority to do so and that you may share any parcel details, files, phone numbers, and contact information you provide.
5. Accurate Information and Responsible Use
You agree to provide accurate, current, and complete information when using our contact form, land report request form, upload features, or email channels. This includes parcel location details, map links, listing links, reference numbers, acreage estimates, intended use, and any questions you want us to review.
- You may not impersonate another person or misrepresent your authority.
- You may not send unlawful, abusive, or deceptive content.
- You may not upload malicious files, corrupted files, or files you are not permitted to share.
- You may not use the site to interfere with our forms, systems, or security controls.
6. Quotes, Scope, and When Work Begins
Submitting a form does not guarantee acceptance of your request and does not create an immediate service engagement. We may review your submission, ask follow-up questions, revise scope, issue a quote, decline the work, or recommend a different starting point before any paid service begins.
Work begins only after we confirm scope and any required payment, onboarding, scheduling, or file handoff steps have been completed. Our deliverables may vary depending on the parcel, the quality of third-party data, weather, site access, map availability, local conditions, and the responsiveness of outside parties.
7. Pricing, Payment, and Refund Policy
LandSentry's fees cover custom research time, analysis, file review, project setup, parcel review, communication time, report preparation, mapping work, coordination, and digital deliverables prepared for your specific request. Because our work is custom, parcel-specific, and often begins with internal review and scheduling before final delivery, all purchases should be made carefully.
Except where required by law, fees paid to LandSentry are non-refundable once a purchase has been completed and work has been scheduled, started, materially prepared, or delivered. This includes custom land reports, parcel research, mapping review, file analysis, consultation time, and other digital or advisory deliverables created for your request.
Refunds are not available simply because you change your mind, decide not to proceed with a land purchase, disagree with our findings, experience delays caused by third parties, or no longer need the work after purchase.
If we confirm that we cannot reasonably deliver the purchased scope before material work begins, or if a duplicate payment or obvious billing error occurred, we may issue an appropriate full or partial refund. Nothing in this section limits any non-waivable rights you may have under applicable law.
8. Client Responsibilities
- Provide the best parcel details and context you have available.
- Share only documents, links, images, and boundary files you are authorized to share.
- Review your own deadlines, transaction timing, and outside professional needs.
- Use qualified local professionals when legal, financial, tax, engineering, survey, or planning advice is needed.
- Avoid sending unnecessary sensitive personal information in free-text fields or file uploads.
9. Files, Uploads, and Reference Materials
Our site may allow you to submit parcel-related files and references, including map links, listing links, boundary files, PDFs, GeoJSON, KML, KMZ, TIFF, CAD, survey materials, screenshots, and registry reference numbers. You remain responsible for the legality, permissions, and accuracy of anything you submit.
By submitting materials, you grant LandSentry a limited right to access, copy, store, review, process, transmit, and use those materials solely to evaluate your request, deliver services, communicate with you, maintain records, and protect our systems from abuse or fraud.
10. Third-Party Sources and Outside Dependencies
Our work may rely on client-provided materials, registry references, map layers, satellite or aerial imagery, public records, seller or listing information, local contacts, outside tools, and other third-party sources. We do not control those sources and do not guarantee that they are complete, current, accurate, available, or suitable for your intended use.
Timeframes may also be affected by public office response times, weather, travel conditions, file quality, incomplete parcel references, or delays caused by third-party service providers.
11. No Guarantee of Outcome
LandSentry does not guarantee that a parcel is suitable, buildable, dispute-free, marketable, accurately represented by third parties, free from access challenges, free from environmental issues, or financially attractive. We do not guarantee that a seller will close, that agencies will approve a plan, that a lender will finance a transaction, or that your desired timeline will be met.
12. Intellectual Property and Deliverable Use
The site content, branding, copy, design, and LandSentry-prepared deliverables remain the property of LandSentry or its licensors unless stated otherwise in writing. Subject to payment and these terms, we grant you a limited, non-exclusive, non-transferable license to use purchased reports and deliverables for your own internal review, family review, advisor review, or transaction evaluation.
You may not resell, publicly publish, mass distribute, repurpose, white-label, or claim authorship of our reports or deliverables without prior written permission.
13. Website Security and Acceptable Conduct
- You may not scrape, probe, overload, or attack the site or its forms.
- You may not bypass or interfere with reCAPTCHA, rate limits, or anti-abuse controls.
- You may not attempt to gain unauthorized access to the site, its data, or related systems.
- You may not use the site in violation of privacy, intellectual property, or other applicable laws.
14. Privacy and Communications
By submitting a form, you agree that LandSentry may contact you to respond to your inquiry, request clarification, discuss scope, provide pricing, deliver updates, and administer purchased services. Our collection and handling of personal information is described in our Privacy Policy and Cookie Policy.
15. Limitation of Liability
To the fullest extent permitted by law, LandSentry and its owners, affiliates, staff, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost opportunity, failed transactions, delay losses, financing losses, or reliance-based losses arising out of or related to the site, our communications, or our deliverables.
To the fullest extent permitted by law, LandSentry's total liability for any claim tied to a paid service will not exceed the amount actually paid to LandSentry for that specific service.
16. Indemnity
You agree to defend, indemnify, and hold harmless LandSentry and its affiliates, personnel, and service providers from claims, losses, liabilities, costs, and expenses arising from your misuse of the site, your breach of these terms, your submission of unauthorized or unlawful materials, or your violation of another person's rights.
17. Refusal, Suspension, and Termination
LandSentry may refuse a request, suspend communications, cancel an unpaid request, or stop using the website relationship where we reasonably believe there is abuse, fraud risk, improper conduct, inaccurate information, security concerns, non-cooperation, or a legal or safety reason to do so.
18. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of Jamaica, without regard to conflict of law rules. You agree to the jurisdiction of the courts of Jamaica, subject to any mandatory consumer or data-protection rights that cannot be waived under applicable law.
19. Changes to These Terms
We may update these Terms of Use from time to time to reflect changes in the business, site functionality, or legal requirements. The updated version becomes effective when posted on this page unless a later date is expressly stated.
